Terms & Agreements
By booking, you agree to the terms listed but may inquire with any specific questions.
1. Scope of Work & Schedule:
The photographer and clients are to arrive for the session and prepared to start at the agreed time and location to be confirmed 1-2 days prior to the shoot. The client agrees to provide confirmation for the appointment the day prior to the session via photographer session reminder. If there is no confirmation made for the appointment 12 hours before, your appointment is assumed to be canceled so the photographer can still have time to move up the waiting list. Notification of any changes in schedule or location must be made in a timely manner and agreed on by the photographer. The session is starting on the time agreed upon, not arrival at that time. Please arrive a few minutes early to be prepared and start at the time provide, not arrive at the time provided..
2. Payment:
After your booking, the photographer will reserve the agreed upon time and date by both parties. The amount will be due in full the day of the session in the preferred method by the photographer. A receipt can be provided upon request. A payment made in a form other than provided will result in an additional fee.
3. Work Product:
All photographs will be shot in digital format. Digital photos will be available on a private online gallery ready for download no later than 8 weeks after the session date. Photos will be delivered as high-resolution JPEG files in an online gallery. RAW files will not be provided. When the online gallery is delivered, it will remain open for 14 days from delivery date. It is the client's responsibility to download images from the online gallery. After 14 days, the gallery will automatically delete and can not re-open. No exceptions allowed. Images are NOT to be edited/ altered in any way under ANY CIRCUMSTANCES. This includes cropping, color changing, adding filters, liquifying, adding/ deleting things, etc.
4. Late Arrivals:
Client's that arrive late to the agreed session details will have only the remaining allotted time for the session with the requirement to pay the full agreed upon time slot. Clients arriving more than 5 minutes late to the session, will result in cancellation and may be rescheduled with a $25 fee. If client does not arrive and the photographer has already arrived to the session, an invoice will be sent for 50% of your agreed upon total. Please arrive 5 minutes early to begin on time. There will not be time to get dressed, add accessories, etc. unless you arrive early. Keep in mind with scheduling- traffic, time of day, parking, finding the meeting spot, etc.
5. Rescheduling/No Shows
If client chooses to reschedule due to any reason other than weather, there must be a 24 hour notice. If it is less than 24 hours, a $25 fee will be added on to the reschedule.
If client ghosts/no shows after confirming or do not respond to the confirmation message they will be no longer be allowed on the shooting list unless they pay up front in full for a session and that will allow no reschedules. If they are late to that session, it will be canceled and the amount will not be returned.
If there are weather related issues, photographer will be in contact to make a decision. Photographer is not responsible for added costs of session in the case of weather related reschedules (hair, make up, location fee's, etc.) If client chooses to move forward with the session with the knowledge of possible weather related issues, the full amount of the session fee will still be due regardless of time used before weather related issues as well as not applying extended time.
6. Indemnification:
If photographer is unable to perform the services in this contract due to illness, emergency, fire, casualty, unsafe environment, threat, act of God or any cause outside its control: photographer will reschedule or make reasonable efforts to arrange a substitute photographer who is prepared to perform the services under this contract for the agreed price.
If photographer is unable to deliver photographic materials due to technical malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the photographer, the photographer will not be liable for any consequential loss arising from the non-delivery, and the liability of the photographer to the client should be limited to the repayment of amounts paid to the photographer under this agreement.
Client understands and agrees that photographer is not required to maintain copies of the photos from this session 14 days after the online gallery has been delivered to client. The client will have 14 days after gallery delivery to make the photographer aware of any issues, discrepancies, technical problems or any other complaint regarding photos, their quality and contents. After this 14-day term has expired, the photographer will no longer be liable to the client for any corrections, damages, or possible refunds, re-edits or re-shoots.
Client agrees photographer is not responsible for any and all personal injury which may occur immediately before, during or after the course of the photography session (including any personal injury arising from or connected with any negligent act or omission on the part of photographer). This includes on site/ public property and private property including the photographer's home studio. Photographer discloses the possibility of pet related allergies in the home studio due to the studio being a pet friendly area.
Client is responsible for any damage made to the home studio, equipment, props, or belongings. Photos will not be released until the invoice for the damage is paid in full.
7. Permissions and permits:
Client will obtain all permissions necessary for photographer to photograph at the session. The photographer has no duty to obtain permission of reception centers, churches, buildings, properties, national parks or other locations. Client understands and agrees that any failure to obtain these permissions resulting in fines to the photographer, or which prevent the photographer from photographing the session is not the fault, liability, or responsibility of the photographer and client agrees: To pay photographer an amount equal to any fine which may be imposed upon photographer as a result of the client’s failure to obtain any required permission; and not to make any claim (including a claim for the repayment of any money paid under this agreement) arising out of or connected with any failure on the part of client to obtain any required permission.
Client agrees that the use of provided images for business on social media, website, and other advertising materials is prohibited unless given written permission per photographer.
